WEBSITE PARTICIPATION
You do not have to login or join our e-mail list to browse our website. If you do log-on or join our e-mail list, your information will only be used to enhance your visits, and will always remain confidential. You may choose to participate on our blog or to receive special offers, newsletters, or e-mails from Fotofly. You may unsubscribe at anytime. By contacting us you agree to let us use your comments, suggestions, articles, stories, or other feedback throughout our site at our discretion. Your name will be credited along with any submission. If you do not wish to have your comments, suggestions, articles, stories, or other feedback shared or you wish to be published as “anonymous” please inform us at the time of submission.
USE OF PERSONAL INFORMATION
When placing an order, you will be required to provide personal information necessary for order processing, shipping, and payment. Name, e-mail address, mailing address, shipping address, daytime phone numbers, credit card number, and expiration date are required for all orders. All customer credit card numbers are sent to our online payment processor using encrypted SSL communication. Your name and past orders may be saved; however credit card information will NEVER be kept on file by Fotofly, nor is it stored by our gallery host site, Simple Photo. We will use customer e-mail addresses for correspondence, but we do not share this information with outside parties, except as is necessary to complete that order. Customer information may be shared with the employees of FotoFly, Simple Photo or any third party vendor fulfilling the order.
Our Third Party Relationships
We have established several relationships with third party vendors to better serve our customers and to offer them product savings.
Simple Photo and Cory Adams photography work in close conjunction with FotoFly to ensure accurate and timely order fulfillment. These vendors will only have access to personal information needed to process such orders. These vendors have agreed to not use any personal customer information for any other purpose than order fulfillment.
FotoFly has and will form links to third party vendor websites to offer private galleries, discounts, promotions, and products. We may from time to time share non-personal information with these third parties for marketing research purposes. We will not share any information regarding a customer’s personal purchases.
From time to time FotoFly may engage third parties to track and report the performance of this website. No individual personal information will be shared with any such party.
FotoFly may use a third party to assist in distributing marketing and promotional materials to those customers who have agreed to receive such offers. These third parties will only have access to information to the extent necessary and may not use any personal customer information for any other purpose.
PASSWORD PROTECTION
FotoFly ensures that photos will be password protected before being uploaded to our gallery host site. Our host site, Simple Photo, “does not disclose your information through sale, trade, or rent to others.” FotoFly is also dedicated to protecting the privacy of your photos and will not disclose your information through sale, trade or rent. We require that any third party we share information with for order fulfillment be bound by this same commitment. If a customer wishes to share their own photographs, passwords or disclose their own personal information they may do so at their own discretion and responsibility. The customer may use the tools available to them through our website and our hosting gallery to share their photographs. By choosing to do so, the customer, is implicitly authorizing FotoFly and Simple Photo to share the specific images to any third parties that the customer has specifically chosen. Any images uploaded to Facebook for sharing and viewing purposes by the customer will only be uploaded to the customer’s chosen Facebook page and FotoFly is released from any privacy liabilities associated with Facebook, Twitter, or any other third party individual, site, or entity.
SECURE CREDIT CARD TRANSACTIONS WITH AUTHORIZE.NET
We currently use Authorize.net as our Credit Card Transaction provider for our online orders. By using Authorize.net we are CONFIDENT that your valuable credit card and personal information will be PROTECTED. If you are placing an order, you will be required to provide personal information necessary for order processing. This information will be used for order processing ONLY. Your name and past orders may be saved; however, credit card information will never be kept on file, and personal information will not be sold, exchanged or distributed to third parties. Terms & Conditions
Thank you for visiting FotoFly.com. All information found on this website is for your general use only. By accessing the FotoFly.com or myfotofly.com website in any way, you are bound by these Terms and Conditions. We ask that you please respect our business by agreeing to our Terms and Conditions or by ceasing to use our website.
RETURNS & EXCHANGES
Because of the unique and personal nature of our product, once a purchase is made and the customer leaves the store with the product, or the product has been printed or shipped to the customer there will be no returns for a refund. Sheets, enlargements, and other products are prepaid and may not be returned once printed either by FotoFly or by our lab. Any sheets, enlargements which when printed are flawed or defective due to a printing error will be replaced. If a customer receives a cd/flash drive and the images are not retrievable or the cd/flash drive is defective then the cd/flash drive will be replaced. However, no additional images will be added to the cd/flash drive unless those images were ordered and left off the cd/flash drive at the time of purchase, due to a technical error. There is a non-refundable deposit upon ordering the Artistry CD. This deposit may vary in amount and will only be applied toward the price of the Artistry CD. The Artistry CD will only be ordered with the customer’s consent or implied consent by paying the non-refundable deposit.
SHIPPING
FotoFly ships all products using USPS and UPS. FotoFly is not responsible for products that are damaged due to negligence by USPS or UPS nor their employees and carriers. FotoFly is also not responsible for products that are not received due to an inaccurate shipping address given by the customer. If a product is returned due to a wrong address, the customer will be responsible for the newly incurred shipping charge.
FOTOFLY COPYRIGHTS and TRADEMARKS
All site content, including any images, names, and logos identifying FotoFly, myfotofly.com or any third party and their products and services are proprietary marks and may not be reproduced in anyway without permission of FotoFly and/or third parties. FotoFly has made reasonable efforts to follow the requirements and guidelines of Copyright and Trademark law. If a copyright or Trademark issue arises please inform FotoFly (info@fotofly.com) immediately so that we may respond to any matters of dispute as quickly as possible.
Any Photographs taken by FotoFly are the sole property of FotoFly until a copyright release is given to the customer at the time of purchase. Any copying of images, whether physical or electronic are illegal and violators will be prosecuted. FotoFly reserves the right to share a copyright with a customer, unless specific documentation is signed stating otherwise. Once a customer purchases the copyright release of an image or images FotoFly is responsible to provide legal documentation to the customer of the copyright release so that the customer may reproduce the image or images. FotoFly reserves the right to require the customer to give acknowledgement to FotoFly for any image when it is being used in any public setting, for advertising, or in any other manner that FotoFly has not explicitly given documented release for.
